Terms of Service
1. Definition
The seller is Regal Souls Creations ehf, ID number 650523-0590, VAT number 149978.
The buyer is the person who is registered as a buyer on the account.
2. 14-day right of return
The buyer can return a product purchased from the seller within 14 days, choose a new product, or receive a full refund. There is no right of return on specially marked products and customised artwork. When returning a product, it must be in its original condition. The seller reserves the right to verify within a reasonable time that the product is in order and to prevent any abuse of the 14-day right of return.
VALID FOR ALL PRODUCTS:
• An invoice is a condition for product returns.
• If you choose to get a product refunded, it is a condition that you have a purchase receipt or that the purchase is registered on a social security number.
• The product must be in its original packaging and condition.
• The product must be unopened, unused and undamaged.
• Reimbursement may decrease if there are changes to reduce value-added tax or other public levies.
3. Order
An order is binding when it is registered on the seller's server. It happens when the buyer has confirmed the order. The seller must also process the buyer's order if it is consistent with the product selection and pricing. The buyer has the right to cancel the purchase according to the law on consumer purchases; see more in Article 9.
The seller sends the buyer a confirmation when the order is registered, but only if the buyer registers his email address during the purchase. The buyer is advised to carefully study the order confirmation when it is received and ensure it is per the intended order.
Deviations from the order and order confirmation shall be interpreted as a new offer from the seller that can be rejected or accepted. The buyer also has the right to make the original order valid if it is consistent with what the seller offered. If the buyer wants to change an order after receiving confirmation, he must do so the same day by sending an email with relevant information to the email address regalsouls@regalsouls.is
4. Information
The seller always provides information about products to the best of his knowledge. The seller publishes all information subject to faults, viruses, printing, display and typing errors in text, prices and images. Furthermore, the seller reserves the right to cancel the buyer's order in whole or part if the product is sold out or he cannot deliver a specific product for any reason.
5. Price
The seller reserves the right to cancel orders, e.g. due to incorrect price information, and change prices or stop offering product types without notice. We reserve the right to confirm orders by telephone. The total cost is stated before the buyer finally confirms the order. All the costs of the order are stated there, e.g. service, shipping, etc. Only special cases may result in additional costs after order confirmation, for example, failures, viruses, printing, display and input errors in text, prices and images.
Prices are subject to change without notice.
6. Delivery and Delay
Delivery is considered to be within the normal time limit from the date of invoice issue. The seller delivers products only within Iceland. The seller informs the buyer of the estimated delivery date by e-mail.
The appropriate delivery service distributes the orders to individuals. The delivery, warranty, and transport terms of the delivery company apply to each case. According to this, the seller is not responsible for any damage that may occur to the product in transit. If the product is damaged when sent from Regalsouls.is to the recipient, the damage is the buyer's responsibility. Damage after the product has been delivered is the buyer's responsibility.
7. Review of products
After receiving the order, the buyer must check whether it is per the order confirmation, whether anything has been damaged in transit, and whether all products are according to the product description and free of defects.
These terms assume that the buyer has read and familiarised himself with the nature and content of the product. The customer's normal observation time is considered to be within 14 days of receipt. After 14 days, the seller reserves the right to verify the buyer's statement within a reasonable time limit before resolving the buyer's complaint.
8. Right in the event of defects or omissions
If the product is defective or something is missing, the seller must offer the buyer a new product, discount, or cancel the purchase. It depends on the circumstances which way is chosen in each case. Notification of defects must be received verbally or in writing. It is recommended that the notification is received within seven days of discovering the defect. Due to record value, it is recommended that the buyer send an email about the defect and keep a copy. The seller sends back confirmation of receipt of the email. The consumer's right (consumer means a person outside of business activities) to have a defect compensated is per the Consumer Purchase Act no. 48/2003. The seller reserves the right to verify within a reasonable time that the product is defective.
9. Liability
The seller's guarantees do not entail limitations on the rights provided for in the law on consumer purchases. Liability for product defects is per the Consumer Purchase Act 48/2003 and is based on the date of purchase for individuals. In the case of the sale of a product to a company (commercial activity), the warranty for defects is one year from the date of purchase according to the Act on Purchases of Liquid Assets Act No. 50/2000.
The warranty is not confirmed unless the purchase note is presented. The warranty does not cover normal wear and tear or use.
The warranty is void if the product has been poorly maintained and is obviously damaged due to the owner's negligence. It is also cancelled if use can be attributed to bad or incorrect handling. The buyer is advised to study carefully the instructions for the care and maintenance of the product.
After the warranty period ends, the seller is not obliged to offer discounts, exchange products, etc., but it reserves the right to verify within a reasonable time that the warranty terms cover a defect. In the event of a warranty resolution, the seller is obliged to offer the buyer a new product, a discount, or a cancellation of the purchase. The choice depends on the circumstances in each case.
10. Privacy
The seller promises the buyer complete confidentiality regarding all information provided by the buyer in connection with the transaction. Information will not be disclosed to third parties under any circumstances. However, the buyer can receive an offer by email, and the seller will then only use the information needed for this, e.g. email address.
11. Ownership
Sold goods are the seller's property until the purchase price is paid in full.
Account transactions or other forms of credit do not remove the seller's property rights until full payment has been received.
12. Resolution of doubts
Always try to solve all issues in the simplest way possible. If this is not possible, the matter can be referred to the Complaints Committee for Services and Liquidity Purchases, which is hosted by the Consumer Agency. As a last resort, you can take the case to court. It shall be done in Icelandic jurisdiction and the jurisdiction of the seller.
13. Taxes and fees
All prices in the online store include VAT, and invoices are issued with VAT.
